Debate: One Nation One Civil Service — 27 Feb 2020
DEBATE (1) One Nation One Civil Service
This idea is neither practical nor desirable. Every service has a role to play in their own distinct field. There are certain checks and balances which some services like Indian Audit &Accounts service or other Accounts services like Indian Defence Accounts Service, Indian Civil Accounts service keep on spending departments. Once becoming part of one service everyone loses its identity. Do we merge Indian Revenue Service both Income tax and Customs and GST with all the services. How can it work. Instead of having specialists for the field one is recruited they all become jack of all trades master of none. This is a weird idea which if pursued will mean end of a well set ,well established and well defined system of administration. Already immense damage has been done to the Railway Administration by announcing off the cuff merger of all Group A services which include five Engineering services and three Group A services which are part of Civil Services Examination. For creation of any service first the Recruitment Rules are framed. Here we create a service without application of mind to what contours the service will have. The decision on the Railways has played havoc with the careers of civil servants. In the long run it is bound to create mess and confusion not conducive to the smooth run of the organisation. To replicate it on the entire bureaucracy is ill-advised and not workable at all.

Respect dignity of the individual
It is past 70 years since the Constitution of India came in to force. People, who had suffered long slavery, humiliation of the individual, poverty, surviving malignant and hugely corrupt regimes and unable to pursue livelihood or business of choice felt elated when it assured dignity of the individual among other hopes raised by the opening words of the preamble. It is disheartening to note that individual dignity has suffered most in the journey of democracy in India in these seven decades. It is not only the political corpus which hurts dignity of the individual, instances of bureaucratic attempts at misconstruing the words & expressions of the law are aplenty which make living of the individual miserable and doing business almost impossible. It falls on the shoulders of the judiciary to deliver justice to the individual from small things like cleaning sewers, streets and public toilets to actual heinous crimes against the dignity of the person. It only adds insult to the injury if the Nirbhaya case is taken as a test case. Can there be any worse attack on the dignity of a person than rape? Even after the sentence is pronounced, it remains un-implemented under the guise of rights of the guilty and only delays justice to the victim and restore her dignity even when the public opinion strongly seeks swift punishment. Delay of the kind in rape cases is nothing more than repeated assault on the dignity of the individual. Individual dignity is torn to pieces in courts/quasi-judicial fora by lying litigants or their advocates. Surely, the Anglo-saxon jurisprudence has completely failed India, which had practiced stouter justice administration practices like the Panchayat/ refined as Nyaya Panchayat. It can be formalised to hear cases on day-to-day basis and can be presided by a qualified judge eligible to adorn the High Court/Supreme Court Bench. We have fire/medical emergency functioning 24x7 and ICU/ICCU. Similar facility can be created for crimes like rape and gang rape to protect the dignity of the individual guaranteed by the constitution without curtailing the rights of the criminals, which will deter such heinous violations of individual dignity by the swift remedy provided by the law and justice in India. Everyone entering a public office, elected or appointed is bound to adhere to, state, tell or uphold the truth to do justice to all as enshrined in the preamble, but tend to forget it in actual practice. In the process, dignity is the first casualty. Such a situation breeds inefficiency, delay, loss of productivity, corruption etc. paralysing governance ultimately. The country has experienced in these seven decades growth of corruption and decline of ease of doing business and unhappiness for the people facing difficulty in day-to-day living. Is it too much to ask the parliament and state assemblies, governments of the union and states, judiciary from the Supreme Court down to magistracy and public servants to respect the dignity of the individual and create an environment of ease of doing business and ease of living in India?

Agony of officers
Thank you for publishing the agony of officers deferred for promotion despite nothing pending against them. Has the DoPT amended rules only for IRS ? Persons with CBI charge sheet are getting promoted in IPS whereas IRS officers are being humiliated by deferring promotions. Does deferring has legal sanction as per DoPT rules ? Rule of law has no place in this administration.
